1. Acceptance of Terms
By creating an account or using Perfumind ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Perfumind is a self-hosted fragrance platform providing a database of perfumes, AI-powered discovery tools (alternative finder, semantic search, recommendations), personal wardrobe, diary, and wishlist tracking, and a layering lab. Some features require a paid subscription.
3. Account Registration
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorised access.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose.
- Post content that is defamatory, offensive, or infringes third-party intellectual-property rights.
- Attempt to reverse-engineer, scrape, or systematically download content from Perfumind.
- Circumvent subscription limits or impersonate other users.
- Interfere with or disrupt the Service's infrastructure.
5. Subscription and Billing
Paid plans are billed on a weekly or monthly basis through Polar, who acts as the Merchant of Record for all transactions. Polar handles payment processing, sales tax, and invoicing. Perfumind never stores your card details.
Charges are non-refundable except where required by applicable law. You may cancel at any time; access continues until the end of the current billing period. Pricing changes will be communicated with at least 30 days' notice to active subscribers.
6. User Content
You retain ownership of content you create (diary entries, reviews, profile data). By submitting content, you grant Perfumind a non-exclusive, worldwide licence to use it solely to operate and improve the Service. Perfumind reserves the right to remove content that violates these Terms.
7. AI-Generated Content
AI features are powered by OpenAI's language models via OpenRouter. Recommendations and search results are for informational purposes only. Perfumind does not guarantee the accuracy of AI-generated output and is not responsible for decisions made based on it.
8. Intellectual Property
All software, design, text, and data comprising the Perfumind platform (excluding user-submitted content) are owned by Perfumind or its licensors and protected by applicable intellectual-property law.
9. Disclaimers
The Service is provided "as is" without warranties of any kind. Perfumind does not guarantee uninterrupted availability or the accuracy of third-party fragrance data.
10. Limitation of Liability
To the fullest extent permitted by law, Perfumind shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Total liability shall not exceed the amount you paid in the 12 months preceding the claim.
11. Termination
We may suspend or terminate your account for violation of these Terms. You may close your account at any time via account settings. Upon termination, your data will be handled in accordance with our Privacy Policy.
12. Governing Law
These Terms are governed by the laws of the Republic of Turkey, without regard to conflict-of-law principles. For users in other jurisdictions, mandatory local consumer-protection laws continue to apply.
13. Changes to Terms
We may revise these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance. Material changes will be communicated by email or in-app notice.
